The word culpability has been used a lot these days, but many people still don't know what it means. Let's talk a bit about culpability here. Culpability is a word used a lot in the area of justice, where it is attributed to a person if they have committed an illegal act. There is no crime without guilt, so the principle of culpability is used to confirm whether the person who has committed an act is guilty and if it is found that the person is guilty, the penalty will be applied.


There are some causes in which guilt does not exist:

  • Existence of mental illness: where the person does not have the correct perception of the act carried out by them and this is proven through a diagnosis of some illness or inadequate mental development.
  • Minority: each country has an age in its law at which a person is considered a minor, that their actions cannot be judged as a person who is criminally liable, and so socio-educational measures are applied to the minor, such as reparation for the damage committed, rendering of services to society, probation or semi-liberty, internment in specialized entities.


Each country has in its law the measures that will be taken in the face of crimes or infractions committed by the minor of that country. There are other situations in which guilt cannot be applied, we can talk about that another time. We know then that guilt means the connection of the person to the illicit fact committed by them in which they were aware of their illegal act but still committed it. The prosecution and defense parties must then present the evidence in order to convince the judge of the guilt or innocence of the accused person.

The judge impartially analyzes the evidence presented. The person is judged by the judge and, if guilty, the sentence is imposed, thus confirming their guilt.
